This Acceptable Use Policy (“AUP”) applies to everyone who uses services provided by Tigernethost, OPC. It forms part of the Terms of Service. We wrote it to keep our network safe for the schools, government offices, and businesses that depend on us — and to comply with Philippine and international law, including the Cybercrime Prevention Act of 2012 (RA 10175), the Data Privacy Act of 2012 (RA 10173), the Anti-Child Pornography Act of 2009 (RA 9775), and the Anti-Photo and Video Voyeurism Act of 2009 (RA 9995).
You are responsible for everything that happens on your account — whether you did it or someone else did. If your account is used to break this AUP, we may act without prior notice.
Zero-tolerance content
We will immediately suspend any Service used to host, distribute, link to, or process the following, and report to Philippine authorities where the law requires it:
- Child sexual abuse material (“CSAM”) or any content that sexualizes minors, in any form;
- Content that promotes, incites, or facilitates terrorism, mass violence, or genocide;
- Material used to blackmail, dox, or make credible threats of violence against a person;
- Content posted in violation of RA 9995 (non-consensual intimate images / “revenge material”).
Suspensions under this section are made without notice and are not reversible unless the material is removed and, where applicable, we have cooperated fully with law-enforcement authorities.
Other prohibited content and activity
You may not use the Services for any activity that:
- Violates Philippine law, the law of any jurisdiction from which the activity originates or is received, or any applicable international treaty;
- Infringes intellectual-property rights (piracy, unlicensed distribution of software, films, music, or e-books; sale of counterfeit goods);
- Is fraudulent or deceptive (phishing, credential harvesting, forged headers, fake e-commerce, romance scams, investment fraud);
- Distributes malware — viruses, ransomware, spyware, keyloggers, remote access trojans, or software designed to bypass access controls;
- Operates command-and-control or coordination points for botnets, worms, or similar malicious infrastructure;
- Provides gambling, lottery, or wagering services not licensed by PAGCOR or the applicable authority;
- Provides adult content that is unlawful in the Philippines;
- Violates the privacy or publicity rights of a third party or discloses personal data without lawful basis.
Network and security abuse
You may not:
- Scan, probe, or attempt to breach the security of any system without the operator’s written consent;
- Launch or participate in denial-of-service (DoS/DDoS), amplification, or reflection attacks;
- Forge TCP/IP packet headers, email headers, or any identifying information;
- Interfere with the proper functioning of the Services, other customers, or upstream carriers;
- Bypass authentication or resource limits on any system, including our own;
- Use the Services to test load, penetration-test, or reverse-engineer our infrastructure without our prior written authorization.
You are responsible for keeping your services patched and secured. If a compromised account is used to abuse the network, we may suspend it and pass on any fees or fines we incur.
Email, messaging, and spam
Unsolicited bulk email (“spam”), including chain letters and mass messaging without verifiable opt-in consent, is prohibited on all Services. You must comply with the Data Privacy Act, the Consumer Act, and applicable anti-spam laws of the recipient jurisdictions.
Default sending limits on shared hosting plans:
- Maximum 200 outbound messages per hour per account;
- Maximum 1,000 recipients per message;
- Bounce rate must remain below five percent (5%).
Higher volumes require a marketing-grade transactional email plan and pre-approval. Being placed on a public blocklist (Spamhaus, SORBS, UCE Protect, and similar) may result in immediate suspension until the underlying issue is resolved. Cleanup work required to delist an IP or domain may be billed at our then-current hourly rate.
Resource abuse
Shared plans are for genuine hosting use, not for background compute. Without prior written approval you may not:
- Sustain CPU usage above 25% of a single core for more than ninety (90) seconds;
- Consume more than 512 MB of RAM per process for extended periods;
- Run persistent background processes or daemons;
- Perform cryptocurrency mining, distributed computing, or blockchain validation of any kind;
- Operate public file-sharing indexes, video-encoding queues, or public proxy/VPN endpoints;
- Run IRC servers connected to global networks.
We may throttle, suspend, or ask you to upgrade if your usage impacts other customers on shared infrastructure.
Backups and storage
Storage on shared plans is for the primary content of live websites and applications. It may not be used as a general-purpose archive, personal cloud drive, media library for offline consumption, or dead-drop for third parties. We may audit stored content and remove files that are clearly not tied to a live Service.
IP addresses
All IP addresses issued as part of the Services remain the property of Tigernethost. You have a limited, non-transferable right to use them only while subscribed. IPs may not be transferred, sold, sub-licensed, or advertised outside our network. We may reclaim or renumber IPs at any time for operational or legal reasons.
Our monitoring and enforcement rights
We do not actively monitor Customer Content and are not obliged to. We may, however, review specific content in response to a complaint or a law-enforcement request, or where we have reason to believe this AUP is being violated.
Where we find a violation, at our sole discretion we may:
- Remove or block access to the offending content;
- Require you to cure the violation within a stated period (typically forty-eight (48) hours for non-critical issues);
- Suspend the affected Service, an account, or all of your Services;
- Terminate your Services for cause;
- Report the matter, and share relevant data, with law-enforcement authorities or affected third parties where lawful.
For zero-tolerance content and for ongoing attacks, we act without prior notice.
Reporting a violation
To report a violation of this AUP by a Service we host, email [email protected] with:
- Your name and contact details;
- The offending URL, IP address, or account identifier;
- A description of the violation and any supporting evidence;
- Where the complaint concerns intellectual property, a statement made under penalty of perjury that you are the owner or authorized to act for the owner.
We investigate every complete report we receive and respond within a reasonable time, prioritized by severity.
Cooperation with authorities
We cooperate with law-enforcement bodies acting under valid legal process. Where legally permitted, we notify the affected customer before disclosing data so they may seek relief. We may decline requests we consider legally defective or overbroad.
Consequences of violation
Violation of this AUP is a material breach of the Terms of Service and may result in suspension or termination of your Services without refund. You will indemnify Tigernethost against any third-party claim, fine, or cost that arises from your breach of this AUP, as more fully set out in the Terms.
Changes to this AUP
We may amend this AUP at any time to address new abuse patterns, new legal requirements, or upstream provider terms. Where a change is material and non-urgent we will give notice on the site; changes that are required by law or that address an active threat take effect immediately.
